1. Purpose

These Terms of Use govern access to and use of the Qualify CRM platform (hereinafter "the Service"), published by Qualify CRM, accessible at qualify-crm.com.

By accessing the Service, the user unreservedly accepts these Terms. If you do not accept these conditions, you must not use the Service.

2. Service Description

Qualify CRM is a SaaS lead management platform that enables businesses to:

Centralize and qualify prospects from web forms
Manage teams and multi-site CRM projects
Track business activity via dashboards and reports
Integrate forms on WordPress sites via a JavaScript snippet

3. Access to the Service

Access to the Service is reserved for adults or legal representatives of legal entities. Registration requires creating an account with a valid email address and a secure password.

The user is responsible for the confidentiality of their login credentials. Any use of the Service from their account is deemed to be made by the user themselves.

4. Plans and Billing

The Service is offered under various pricing plans (Starter, Pro, Enterprise) whose features are described on the Pricing page. Subscriptions are billed monthly via LemonSqueezy.

A 14-day free trial is offered upon registration. After this period, a paid plan subscription is required to continue using the Service.

5. User Obligations

The user agrees to:

Use the Service in compliance with applicable laws
Not collect personal data without a valid legal basis
Inform persons whose data is collected (leads) of their right to access and deletion
Not attempt to circumvent the Service's security measures
Not use the Service for illegal, fraudulent or harmful purposes

6. Intellectual Property

All elements of the Service (code, design, trademarks, logos) are the exclusive property of Qualify CRM and are protected by intellectual property law. Any reproduction or use without prior authorization is strictly prohibited.

7. Limitation of Liability

Qualify CRM is committed to providing the Service with the greatest care and maintaining optimal availability. However, Qualify CRM cannot be held responsible for service interruptions, data loss or indirect damages resulting from use of the Service.

The user is solely responsible for the data they collect and process via the Service, as data controller within the meaning of the GDPR.

8. Termination

The user may cancel their subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period. Data is retained for 30 days after cancellation, then permanently deleted.

Qualify CRM reserves the right to suspend or terminate an account in the event of a violation of these Terms, without notice or refund.

9. Applicable Law

These Terms are governed by French law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Paris, unless otherwise provided by law.
